This document sets the general terms and conditions for the use of the services provided by www.kitabox.ae. It is hereby agreed upon that any use of any services will be bound by the present and the amended terms and conditions.
All the editorial content and the illustrations of this website are subject to copyrights and are protected by the UAE Laws and regulations and the international applicable laws. They cannot be reproduced and copied in any ways without the prior written consent of Kitabox.
All personal data input voluntary by our clients will remain private and cannot be diffused under any reasons to any third parties. According to the respect of the private life of its users, the company Kitabox commits to collect and process personal data on its website according to the applicable rules and regulations. Despite all the efforts that will be put in place to protect the private data of its clients, Kitabox will not be responsible for any malicious attacks from hackers and/or any malwares of any sorts.
Our clients have the rights at all time to access, correct, modify and delete their own data. All data can be managed under the private section “My Account” or by contacting the company Kitabox, at the email address firstname.lastname@example.org.
These Terms and Conditions exclusively regulate the activity of distribution of boxes containing books, activities booklets and bookshelf to people who have a subscription contract with Kitabox (hereafter, “Kitabox subscription”).
For the purposes of this document, it is agreed that the individuals and/or corporations who have entered into a subscription contract with Kitabox will be referred to as, “Clients”.
These Terms and Conditions and its amendments are made available on the current website to the Clients at the time of purchase of a Kitabox subscription and shall determine the rights and obligations of Kitabox, under Emera General Trading LLC and of the Clients to the different subscription contracts offered on the Site. The Clients must review the Terms & Conditions regularly to be updated about any changes.
By purchasing the Kitabox subscription on the website, the Client declares to have read, understood, and accepted without reservation these Terms and Conditions.
The Terms and Conditions are only valid in English, to be translated to the Arabic language in case of any conflict; however, the English language will prevail.
These Terms and Conditions shall apply on the date of the subscription and they may, however, be subject to change.
ARTICLE 1 – COMPANY OVERVIEW
Kitabox, under the company Emera General Trading LLC, is registered under the trade license number 640498.
ARTICLE 2 – GEOGRAPHIC AREA
United Arab Emirates is our country of domicile. Kitabox is only available for clients based in the UAE. Subscriptions that do not meet this geographic condition will not be taken in consideration.
ARTICLE 3 – ACCESS TO THE SERVICE
The website services at www.kitabox.ae are normally accessible to Clients seven days a week, 24 hours a day, throughout the year except in case of interruption, voluntary or not, in particular due to maintenance needs or major events. Kitabox, under Emera General Trading LLC cannot be held liable for damage of any nature resulting from unavailability of the website.
ARTICLE 4 – CONDITIONS OF THE KITABOX SUBSCRIPTION
The Kitabox subscriptions are available on the website www.kitabox.ae. Kitabox offers 1 month, 3-month and 6-month subscriptions with a one-time payment to be made upfront.
Kitabox subscriptions consist of monthly shipments containing one book and one activity booklet. However, for organization & delivery purposes, Clients subscribing to the service shall receive a “Summer box” in June, containing content for the month of June, July and August.
In addition, Kitabox is offering free gifts to its Clients depending on the activity and these gifts, including bookmark or bookshelf shall be received upon availability.
By subscribing to one of the Kitabox subscriptions, the Client accepts these Terms and Conditions, and the Client acknowledges having read and understood them, and accepts them without reservation and with full knowledge of cause.
In the interest of good administration of the subscription by the Client to one of the Kitabox subscriptions, the Client shall complete a form containing personal information. The information provided must be accurate. The Client must ensure their accuracy and their truthfulness when subscribing. In case of misinformation, Kitabox, under Emera General Trading LLC, cannot be held liable.
Clients will only be considered to possess full product ownership once the website has received, in full, all payments for sums respective to the products and delivery charges.
ARTICLE 5 – UNSUBSCRIPTION
The Client may cancel his order within seven (7) days after the purchase of the subscription in accordance to the terms and conditions stipulated in Article 15.
No exchange or refunds beyond the above mentioned limit time is allowed. The order shall be deemed irrevocably complete after seven calendar days of the date of purchase.
ARTICLE 6 – DEACTIVATION OF THE CLIENT’S ACCOUNT
In the event of non-compliance arising from the acceptance of these Terms and Conditions, non-payment of the price of an order, intentionally providing wrong information to create the account, or actions that could harm the interests of Kitabox, under Emera General Trading LLC and the public interest in any way, Kitabox reserves the right to suspend access to the services offered on the website or, depending on the seriousness of the acts, to terminate the subscription and the account of the Member without any compensation, notwithstanding any right to pursue any legal action that it might deem appropriate.
The company also reserves the right to refuse service to a Client who has been excluded or penalized for such actions.
ARTICLE 7 –PAYMENT
We accept payments online using Visa and MasterCard credit/debit card in AED. We also accept payments by cash on delivery in UAE Dirhams only. If you make a payment for our products or services on our website, the details you are asked to submit will be provided directly to our payment provider via a secured connection. The cardholder must retain a copy of transaction records and Kitabox policies and rules.
Multiple shipments may result in multiple postings to the cardholder’s monthly statement.
Kitabox, under Emera General Trading LLC, cannot be held responsible for any fraudulent use of the payment method used.
In accordance with current regulations, Member bank or card details will not be kept by Kitabox, under Emera General Trading LLC.
Occasionally, Kitabox will offer discount on the Kitabox subscription services with the use of coupons. The coupons shall be installed by Kitabox for a limited period of time, at the discretion of Kitabox.
ARTICLE 8 – EVIDENCE
The Client recognizes the validity and the probative value of electronic exchanges and records kept by Kitabox, under Emera General Trading LLC, and admits that these have the same probative force as those written and signed by hand. The Client must retain a copy of all transaction records and the Kitabox, under Emera General Trading LLC Terms and Conditions.
ARTICLE 9: DELIVERY POLICY
The box delivery service is only available in the United Arab Emirates. Subscriptions that do not meet this geographic condition will not be taken in consideration. Kitabox, under Emera General Trading LLC will NOT deal or provide any services or products to any of OFAC sanctions countries in accordance with the law of UAE.
Kitabox shall offer free delivery to partner schools and nurseries. The list of partner schools and nurseries is available on the shipping options page. In case of change of school or nursery during the Kitabox subscription to another school or nursery non covered by Kitabox, Clients will need to provide an address at home for delivery and monthly fees of 15 AED will be applicable
Kitabox will be delivered to the Clients, between 2 weeks to 5 weeks after the subscription to Kitabox to the address provided in the information form, “My Account,” completed by the Client during registration.
In case of change of address, it is up to the Client to provide notification at least fifteen days before the next shipment.
In case of change of country, it is up to the Client to provide notification at least fifteen days before the next shipment and contact email@example.com to notify the change. Kitabox will refund the remaining months to the pro-rata of the annual subscription, if a relevant proof of residency in the other country is provided.
If the package is returned to Kitabox, under Emera General Trading LLC, a second delivery will be made. In this case, a fee of twenty dirhams (AED 20) will have to be paid by the Client in cash on delivery. If the package is returned to the sender again, there will be no new shipment and no refunds will be made. The product will be held in the website for only two weeks starting the date of the failure of the last delivery, in the event the Client wishes to arrange delivery and/or pick up. After that period, the Product will no longer be available and no refunds of payments will be allowed.
Boxes delivery is the sole responsibility of the Company and will be done through its designated courier delivery partner.
Deliveries are made Saturday through Thursday and do not include Fridays and/or public holidays.
Boxes are usually shipped between the 10th and the 25th of each month. The shipment can be extended from the 1st to the 30th of each month in partner schools or nurseries depending on the annual school holidays calendar.
ARTICLE 10 – REFUND/RETURN POLICY
Any complain about the box and its contents must be reported within seven (7) calendar days of receipt of the box. In case of defect in the box and/or the established order, the Client may have a new box. If the box is out of stock, the Client will get the next month’s box free. If the products for the order are out of the stock, Kitabox, under Emera General Trading LLC, will offer alternative products of equivalent quality.
Missing or defective products contained within the box will result in exchange for the same product, depending upon stock availability, or another product. In any case, the liability of Kitabox, under Emera General Trading LLC, is limited to the monthly value of the subscription and the order.
Refunds will be done only through the Original Mode of Payment.
ARTICLE 11 – MAJOR EVENTS
Kitabox, under Emera General Trading LLC may not be considered as accepting liability for total or partial breach of contract that would arise due to Force Majeure Event. A Force Majeure Event relates to any event or circumstance beyond our reasonable control.
During the period of a Force Majeure event, Kitabox, under Emera General Trading LLC is not liable for any failure to fullfil our contractual obligations. The Company will, however, do its best to perform to the best of its ability throughout this period despite the Force Majeure Event.
ARTICLE 12 – INTELLECTUAL PROPERTY
All elements of the Site, whether visual, audio, text, layouts, illustrations, photographs, documents, or other elements, including the underlying technology, are protected by copyright, trademarks, and patents. Total or partial reproduction of the elements available on the website is strictly prohibited.
ARTICLE 13 – CANCELLATION POLICY
In accordance with the current applicable consumption code and as part of remote selling, the Client has the right to withdraw within seven (7) days after acceptance of an offer of subscription. Notice of withdrawal must be made by email via the “Contact” page on the Site. The seven (7) day delay is also applicable in case of withdrawal after receiving the box. This period starts from the date of receipt of the monthly box. The merchandise must be returned in their original packaging and condition. Any incomplete or damaged products, or damaged and/or missing packaging may not be returned, exchanged, or refunded.
If applicable, Kitabox, under Emera General Trading LLC, will reimburse the Client who has notified within the time period that they wish to exercise their right of withdrawal within thirty (30) days from receipt of the notification of withdrawal. Refunds will be done only through the Original Mode of Payment.
ARTICLE 14 – INFORMATION AND FREEDOM
The information requested from the Client in the form at the time of registration is necessary to process the order and may be communicated to contractual distributor partners of the Site involved in the framework of the execution of this order.
In accordance with applicable law, the Client has the right of opposition, the right of access, and the right of rectification of the data concerning them. The Client may require that any of their information be modified, supplemented, completed, clarified, or deleted if it is erroneous, incomplete, or outdated, or when collection or use of the communication is prohibited. To exercise this right, the Client must simply write to us on our “Contact” page
Kitabox, under Emera General Trading LLC reserve the right to use the statistics provided by the information forms that the Clients will complete in order to optimize its service and those of our partners.
ARTICLE 15 – LIABILITY
Kitabox, under Emera General Trading LLC, as a third party cannot be found liable for the contents of partner websites of the Company, and it also cannot be found liable in case of any conflict between the Client and a partner site or brand.
Information allowing the Client to be identified, such as the username and password, are personal and confidential.
The Client is solely responsible for the use of their identifying information, and it must be kept secret. Any disclosure on their part will in no way be blamed on www.kitabox.ae
Any order placed using the Client’s username and password is considered to be placed by them. Kitabox, under Emera General Trading LLC will in no way be held responsible for damages caused by the divulgence of this personal and confidential information by the Clients and subsequent use of this data by a third party.
Kitabox, under Emera General Trading LLC may not in any way be held liable for any damages of any kind, in particular due to the use of subscription services, whether to reputation, to image, or loss of data that might arise from the use of services offered by www.kitabox.ae
ARTICLE 16 – SAFEGUARD CLAUSE
If one or more provisions of these Terms and Conditions are declared invalid under any law or regulation or a final court decision, the other provisions will retain power and scope.
ARTICLE 17 – MINORS
Minor under the age of 18 are prohibited to register as a User of this website and are not allowed to transact or use the website.
ARTICLE 18 – APPLICABLE LAW
Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of the UAE.
These Terms and Conditions are subject to the applicable U.A.E Laws and regulations irrespective of the Client’s country of residence and the place of conclusion of the contract. The Subscriber acknowledges that the communications and computerized records of the Website will be considered by the parties as proof of exchanges, orders, payments, and transactions between the parties unless proven otherwise.
